1. Introduction
PHOTO LAB AL LTD. (“we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy describes what information we collect and how we use, share, and safeguard it when you use the AI GIF Photo mobile application (the “App”). By using the App, you agree to the collection and use of information as outlined in this Privacy Policy. If you do not accept these terms, we respectfully advise that you discontinue use of the App.

Note: We request your explicit permission through an in-app user consent page before sending your images or text prompts to our own servers and transmitting text prompts to OpenAI for prompt refinement and processing.

OUR PRIVACY POLICY APPLIES TO ALL USERS, AND OTHERS WHO ACCESS THE APP ("USERS"). PLEASE CAREFULLY REVIEW THE FOLLOWING PRIVACY POLICY FOR INFORMATION REGARDING THE PROCESSING OF YOUR PERSONAL DATA. BY ACCESSING OR USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.


2. What data we collect
We collect certain technical, usage, diagnostic, and subscription information that is necessary for the operation, maintenance, and ongoing enhancement of our services. When you use AI-powered features, the photos and text prompts you provide are securely transmitted and processed solely to generate the requested content. We do not collect payment card details, and your data is not sold, used for advertising, or processed for purposes unrelated to providing the service.

2.1. Automatically Collected and Processed Data

Device Information: We may collect the type of your device, type of operating system and its version, model and manufacturer, screen size, screen density, orientation, audio volume and battery, device memory usage, mobile carrier, network provider, network type, IP address, timestamp and duration of sessions, speed, and browser.

Analytics and Usage Data: We use Google Firebase Analytics and related tools to collect non-personal information about how the app is used. This includes information such as device type, operating system version, general location (country or region), and in-app interactions (for example, design generation events and feature usage frequency). We do not collect direct personal identifiers such as your name, email address, or personal contact information through analytics tools. Firebase Analytics may assign an anonymous identifier to your device or app instance for statistical purposes. This information helps us understand app performance, improve features, and enhance user experience. This analytics data is anonymized and is not linked to your personal identity. For additional details regarding our service providers, please refer to Section Section 4: Sharing of Your Information.

Crash Logs and Diagnostics: To maintain a high-quality experience, we utilize Google Firebase Crashlytics for crash reporting and diagnostics. If the app encounters an error or crash, Crashlytics will collect relevant technical information such as device model, operating system version, and a crash trace (what went wrong in the code). These reports help us identify and fix issues. Crash reports do not include personal content from your app usage (for example, your photos or designs are not included in crash logs). Crashlytics assigns an installation ID to identify error reports from the same device, but this ID is not used to identify you personally.

Device Permissions: Depending on your usage, the app may request certain device permissions, such as access to your photo gallery or camera (to enable you to select or capture photos for design). These permissions are strictly used for the stated purposes (selecting photos). We do not collect or scan your device for any data beyond the images you choose to use. If you grant access to your camera or photos, the images you take or select are handled as described above under User Photos and Content.

Payment and Subscription Information: AI GIF Photo offers auto-renewing subscription plans (e.g., weekly or yearly subscriptions). Purchases and subscriptions are processed through the Apple App Store. We do not collect or store your financial information (such as credit card numbers) on our servers. Payment processing is handled by the platform provider Apple under their secure systems. We may receive confirmation from the platform that you have started a trial or subscribed (for example, transaction identifiers or subscription status), which we use only to unlock premium features and manage your subscription benefits in the app. We do not have access to your full payment details. Please refer to Apple’s payment policies for more details on how they handle your payment data.

2.2. Data We Collect for AI Features
The App includes AI-powered features such as AI Logo Generator, AI GIF Generator, AI Object Remove, AI Background, AI Art Generator, BG Remover, AI Replace, Photo Enhancer, Photo Colorize, Photo Descratch, AI Illusion Art Generator and others. To provide these services, your input data (such as uploaded images or text prompts) is securely transferred to and processed on our own servers. All data is encrypted during transfer and processing. We retain data only as long as necessary to complete the requested task. It is deleted after processing and permanently removed from our servers within 24 hours.. By using our AI tools, you consent to the processing of your data as described in this section.
What Data We Collect:

Photos (Uploaded Images):
When you use features such as BG Remove, AI Replace, Photo Enhance, Photo Colorize, and similar services, the photos you upload are processed on our secure servers to generate the requested results. Photos remain image content only — we do not extract, retain, or store facial recognition data or structured biometric identifiers. Images are used solely to deliver the requested results and are never used for advertising, profiling, third-party sale, or AI model training.

Text Prompts(Processed by OpenAI as a Third-Party Service Provider):
When you enter a text prompt for features such as AI Logo, AI Video, AI Replace, AI Art, or AI Background, the text you provide is securely transmitted in real time to OpenAI via its API as a third-party service provider solely for prompt refinement and enhancement prior to content generation. OpenAI processes only the text you voluntarily submit. No photos or images are sent to OpenAI. Text prompts are used exclusively for prompt improvement and are never used for advertising, profiling, third-party sale, or independent AI model training. We adhere to OpenAI’s privacy and data handling policies to help ensure your information remains secure.For more information about our service providers, please refer to Section 4: Sharing of Your Information.

How We Collect Data:
You provide photos and text prompts directly to us when you use the AI features of AI GIF Photo. The type of personal data collected depends on the specific features you use and how you interact with the app. We collect photos and text prompts only when you voluntarily upload or enter them within the app. If you grant permission to access your camera or your device’s photo library, we access and process only the photos you select in order to provide the AI features you choose to use. We do not access, collect, or process photos without your explicit action.

Storage and Retention:
User-uploaded photos and text prompts are stored locally on your device and may be temporarily transmitted to our secure servers hosted by Amazon Web Services (AWS) for processing. Text prompts may also be securely transmitted in real time to OpenAI solely for prompt refinement prior to content generation. Photos and text prompts are automatically removed from active processing systems immediately after the requested task is completed. We retain data only as long as necessary to complete the requested task. It is deleted after processing and permanently removed from our servers within 24 hours.


3. How We Use Your Information
We process the information we collect for the purposes outlined below:
To Provide AI-Powered Features: We use the data you provide solely to deliver and support the AI-powered features you request. Text prompts and photos are securely transmitted to our own AI processing servers and used only to generate the requested design outputs and app functionality. Text Prompt Usage: Text prompts you provide are used solely to generate the AI content you request. They are securely processed in real time through the OpenAI API for prompt refinement prior to content generation. We do not use your prompts to identify you, for advertising, or for AI training. Prompt data is processed solely to generate the requested results and is not retained once processing is complete. Photos Usage: Photos you upload or capture are used only to provide the editing or AI features you select. They are securely transmitted and temporarily processed on our servers to generate the requested outputs. We do not use your photos for identity recognition, advertising, profiling, or AI training. Photos are automatically deleted after processing is complete.

For Analytics and Product Development:
We use analytics and performance monitoring tools to evaluate aggregated user interactions, feature usage, and operational metrics. This information enables us to understand service usage patterns, improve existing features, and develop new functionalities. All such analysis is conducted using aggregated and/or anonymized data and is not intended to identify individual users.

To Provide Support and Improve User Experience:
We process information related to support requests, feedback, or other communications you voluntarily submit to provide assistance, respond to inquiries, troubleshoot issues, and maintain service quality. This information is used solely for customer support and service improvement purposes. We do not disclose or share your support-related information with third parties, except as necessary to provide the requested assistance or as required by law.

To Ensure Security and Enforce Our Legal Obligations:
We may process information to detect, prevent, and investigate fraud, security incidents, unauthorized access, violations of our Terms of Service, or other misuse of the App. This processing is necessary to protect the security, integrity, and lawful operation of our services, as well as the rights, property, and safety of our users and our organization.


4. Sharing of Your Information (How and With Whom We Share Data)
We share your information with third parties only as described in this Privacy Policy. When integrating external services, we select providers that implement appropriate technical and organizational safeguards to protect personal data and require them to process information in accordance with applicable privacy standards. While we take reasonable steps to protect your information, no method of transmission to third-party services can be guaranteed to be completely secure. Accordingly, we cannot ensure absolute security once data is transmitted and are not responsible for unauthorized access or loss resulting from the actions or omissions of such third parties. We do not rent or sell your personal data. We may share certain information—such as log data, device identifiers, or approximate location derived from IP address with third-party service providers that support automated data processing necessary for the operation of the App. We may engage the following third-party service providers in order to provide us with necessary infrastructure for delivery and improvement of our services:

We confirm that the third-party AI service provider OpenAI processes user text prompts solely for prompt refinement prior to content generation. No user-uploaded photos are transmitted to OpenAI, and the prompts are not used for advertising, profiling, or independent AI model training. 5. Your Consent
By using the AI GIF Photo App, you acknowledge and consent to the collection, processing, and use of your information as described in this Privacy Policy. This includes the temporary processing of uploaded images and text prompts to deliver AI-generated outputs. Except as outlined in this Privacy Policy, we will not share your personal data, images, or generated designs with third-party advertisers, data brokers, or social media platforms without your explicit consent. Any new features or services that may require sharing of your information will only be implemented after obtaining your prior, informed, and explicit permission. You have the right to withdraw your consent at any time from the app setting page by disabling “AI Data Sharing." Withdrawing consent will not affect any processing that has already occurred but will prevent any future use of your information for the purposes that require consent. We will request your explicit permission through an in-app consent prompt before sending your images or text prompts to our servers or third-party processing providers.


6. Data Retention and Deletion
We retain data only for as long as necessary to provide our services and fulfill the purposes described in this Privacy Policy.
User-Generated Content: Uploaded images, text prompts, and design inputs are temporarily stored on our secure servers solely for the duration of the processing session required to generate AI-powered outputs. These files are deleted shortly after the processed results are delivered to you. The only copies of your content that remain are those saved locally on your device.

Analytics and Diagnostic Data: Aggregated and anonymized analytics, usage metrics, and crash reports are retained for trend analysis, product improvement, and operational monitoring. While we do not retain personal identifiers, these datasets may be periodically reviewed and purged to minimize storage and maintain compliance with data protection principles.

Support Communications: Any information you provide when contacting support, such as email correspondence, will be retained for as long as necessary to address your inquiry and maintain a record of interactions. You may request the deletion of any personal data we hold about you at any time by contacting our support team. Verified deletion requests will be honored in accordance with applicable laws and will remove data from our systems wherever feasible, excluding anonymized or aggregated analytics that cannot be traced back to individual users.


7. Data Security
We implement a comprehensive set of administrative, technical, and physical safeguards to protect the data collected through the AI GIF Photo App.
Encryption and Secure Transmission: All data transmitted between your device and our servers, including uploaded images and text prompts, is encrypted using industry-standard protocols (e.g., HTTPS/TLS) to prevent unauthorized interception.

Access Controls: Access to servers, databases, and storage systems is restricted to authorized personnel on a need-to-know basis. Employee and contractor access is monitored, logged, and periodically reviewed to ensure compliance with security policies.

Secure Storage: User data is stored on secure servers with updated security measures to protect against unauthorized access, modification, or disclosure. Temporary processing files are automatically deleted after the generation of AI outputs.

Monitoring and Auditing: We routinely monitor our systems for potential security vulnerabilities and perform audits to detect and address any unauthorized access or suspicious activity.


8. Children’s Privacy
Our App is not intended for children under the age of 13, and we do not knowingly collect personal information from children under 13. If we become aware that personal data has been collected from a child under 13 without verified parental consent, we will promptly delete such information. Parents or guardians who believe that their child has provided personal information may contact us, and we will take appropriate steps to remove the data. We encourage parents and guardians to supervise children’s use of mobile applications and to help protect their privacy online.


9. User Rights and Choices
We respect your rights regarding your personal data. Depending on your jurisdiction (for example, the EU, UK, California, etc.), you may have certain rights under privacy laws:
Access and Correction: You have the right to know what personal data (if any) we hold about you. Since we do not retain much personal data, this generally applies to information you’ve explicitly provided, such as your email when contacting support. You may request a copy of this data and ask us to correct any inaccuracies.

Deletion: You may request that we delete personal information we have collected from you. As described in the Data Retention section, we routinely delete user images and minimize stored personal data. Upon receiving a deletion request, we will search our systems for any personal data related to you (e.g., your email in support logs) and delete it, unless required to retain it for legal reasons. Non-identifiable analytics data cannot be individually deleted but does not link to your identity.

Opt-Out of Analytics: You can prevent usage tracking by disabling analytics in the App (if available) or using device settings such as “Limit Ad Tracking.” Uninstalling the App will also stop data collection. Currently, our analytics data is non-identifiable, but you may contact us if you have concerns.

California Residents (CCPA): We do not sell personal information. California users may still request access or deletion of their personal data under CCPA. Requests will be handled according to the law, and verification may be required. We aim to respond within legally mandated time frames (typically 30 days).

International Data Transfers: Our servers or service providers may be located outside your country (for example, Google servers in the U.S. process analytics data). By using the App, you consent to such transfers. Where applicable, we rely on approved legal mechanisms, such as standard contractual clauses, to ensure your data is adequately protected during cross-border transfers.


10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make changes, we will update the “Last Updated” date at the end of this policy and publish the revised policy here (and/or within the App). If there are material changes to how we handle your data, we will provide a prominent notice (such as an in-app alert or a notice on our website) and, if required by law, obtain your consent. We encourage you to review this Privacy Policy periodically to stay informed about our data practices. Your continued use of the App after any changes to this Privacy Policy signifies your acceptance of those changes.
